1. Introduction

Welcome to SendFame.com. SendFame.com ("SendFame", "we", "us", or "our") is a service owned and operated by OpenWorld Technologies, LLC, which is the controller responsible for the personal data described in this policy. We respect your privacy and are committed to protecting your personal data. This privacy policy will inform you about how we look after your personal data when you visit our website and tell you about your privacy rights and how the law protects you.

2. Data We Collect

We may collect, use, store and transfer different kinds of personal data about you, including:

• • Identity Data: name, username, or similar identifiers
• • Google Account Data: where you choose to sign in with Google — your Google Account identifier, email address, name, and profile picture (see Section 7)
• • Contact Data: email address, billing address, phone number
• • Payment Data: payment card details processed by our secure payment processors
• • Technical Data: IP address, login data, browser type, device information
• • Profile Data: username, password, purchases, preferences
• • Usage Data: information about how you use our website and services
• • Content Data: prompts, preferences, and AI-generated content including music, lyrics, videos, images, and voice recordings
• • Uploaded Content: photos, images, audio, and other media you upload as input to our generative features (including image-to-video, image editing, and similar tools)
• • Biometric and Likeness Information: facial geometry, voiceprints, body characteristics, and other biometric identifiers that may be contained in photos, audio, or video you upload
• • Acceptance Records: timestamp, version, and IP address recorded when you accept these terms or our Privacy Policy
• • Marketing Data: preferences in receiving marketing from us

3. How We Use Your Data

We use your data for the following purposes:

• • Providing and improving our AI services (music generation, lyrics generation, image creation, video generation, etc.)
• • Processing payments and subscription management
• • Communicating with you about your account, services, and updates
• • Personalizing your experience based on your preferences and usage patterns
• • Analyzing usage to improve our AI models and service quality
• • Providing customer support and addressing technical issues
• • Enforcing our terms and conditions and protecting our rights

4. AI-Generated Content and Data Processing

Our services use artificial intelligence to generate various creative content. Please be aware of the following regarding our AI services:

• • AI Music Generation: We process your input prompts and preferences to generate music across genres including rap, country, and general music styles.
• • AI Lyrics Generation: Your prompts are processed to create lyrics, freestyle rap content, song names, and song ideas.
• • AI Image Creation: We process your inputs to generate album covers, book covers, and visual content.
• • AI Video Generation: Your inputs are used to create music videos and other visual content.
• • Voice Synthesis: We use AI to generate synthesized voices from your inputs, strictly for entertainment purposes.
• • Face to Cartoon Conversion: Your uploaded images are processed to create cartoon versions.
• • AI Sticker Generation: We process your inputs to create custom stickers.
• • Content Moderation: Your prompts and generated outputs are automatically screened to enforce our prohibited-use policies. Content that violates our policies is blocked and may result in account review.

Content Ownership and Usage Rights

• • AI-generated music and lyrics can be used commercially, subject to our terms and subscription plan.
• • AI-generated videos are for personal use only and may not be used commercially without explicit permission.
• • Voice synthesis outputs are for personal, non-commercial use only.
• • Image generations have usage rights that vary by subscription tier.

5. Data Sharing and Transfer

We may share your personal data with:

• • Service providers who perform services on our behalf (payment processors, hosting providers, analytics providers, customer-support providers, email providers)
• • Third-party AI model providers that power our generative features (see Section 6 for details)
• • Business partners who offer complementary services
• • Legal authorities when required by law or to protect our rights
• • Acquirers, investors, or successors in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets

We do not sell your personal data for money. We require third parties to respect the security of your personal data and to treat it in accordance with applicable law, but each third-party AI provider processes data under its own terms and privacy policy as described in Section 6.

6. Third-Party AI Model Providers

SendFame.com does not develop, train, own, or host any of the AI models used by our services. We act as an interface and orchestration layer that transmits your inputs to third-party AI model providers and returns their outputs to you. When you use a generative feature, the following data may be transmitted to one or more third-party providers:

• • Your text prompts and selected parameters
• • Photos, images, audio, and other media you upload
• • Any biometric or likeness information contained in your uploads (see Section 8)
• • Technical metadata required to route and bill the request

Categories of third-party AI providers we currently use include providers of large language models, image-generation models, image-editing models, video-generation models, music-generation models, voice-synthesis models, and content-moderation classifiers. These providers operate their own infrastructure, may be located in the United States or other countries, and process your data subject to their own privacy policies, data-retention practices, and terms of service. Some providers may temporarily retain inputs and outputs for abuse monitoring, safety, debugging, or model evaluation as permitted by their terms. SendFame.com does not control the data-handling practices of third-party providers and is not responsible for their processing once data is transmitted to them. To the extent permitted by law, we configure our integrations to disable training on user content where the provider offers that option, but we cannot guarantee a particular provider's behavior at all times. By using our generative features, you acknowledge and consent to this third-party processing.

7. Google Sign-In and Google User Data

SendFame.com offers "Sign in with Google" as an optional way to create and access your account. This section describes how we access, use, store, share, and protect data we receive from Google, and it applies in addition to the rest of this policy. If you instead create your account with an email address and password, we receive no data from Google.

Google user data we access

When you choose to sign in with Google, we request only the basic, non-sensitive OAuth scopes openid, email, and profile. Through those scopes Google provides us with:

• • Your Google Account unique identifier
• • Your email address, and whether Google has verified it
• • Your name and profile picture URL, where you have made them available

We do not request and do not receive access to Gmail, Google Drive, Google Calendar, Google Contacts, YouTube, or any other Google service, and we never receive your Google password.

How we use Google user data

We use the data described above only to provide and improve user-facing features of SendFame.com, specifically to:

• • Create your SendFame.com account and authenticate you each time you sign in
• • Identify your account and associate your generations, credits, and purchases with it
• • Display your name and profile picture to you within the app
• • Send you service and transactional email about your account, your purchases, and your completed generations, and marketing email only where you have opted in
• • Provide customer support, and detect and prevent fraud, abuse, and duplicate or disposable account creation

How we store and retain Google user data

Google user data is stored in our PostgreSQL database, hosted on Supabase infrastructure in the United States. It is encrypted in transit using TLS and encrypted at rest by our hosting provider. We retain it for as long as your account remains active. You may delete your account at any time from your account settings or by emailing info@sendfame.com; when you do, we delete the Google user data we hold within thirty (30) days, except where a longer retention period is required for legal, tax, accounting, or fraud-prevention purposes.

How we share Google user data

We do not sell Google user data, and we do not share or transfer it to data brokers, information resellers, or advertising platforms. We disclose it only to service providers who process it on our behalf under contract and only as necessary to operate SendFame.com — specifically our hosting and database provider, our transactional email provider, our payment processor, and our customer-support provider — and to legal authorities where we are required to do so by law. We do not transfer Google user data to any third party for advertising, for training artificial intelligence or machine learning models, or for any purpose unrelated to providing the service you requested. Google user data is not transmitted to the third-party AI model providers described in Section 6.

How we protect Google user data

Google user data is protected by the security measures described in Section 10, including encryption in transit and at rest, strict internal access controls limiting access to personnel who need it to operate the service, signed and expiring session tokens, and documented data-breach response procedures.

Limited Use

SendFame.com's use and transfer of information received from Google APIs to any other app will adhere to the Google API Services User Data Policy, including the Limited Use requirements. In particular, we do not:

• • Use Google user data for serving, targeting, or measuring advertising
• • Sell or transfer Google user data to data brokers, information resellers, or advertising platforms
• • Use Google user data to determine credit-worthiness or for lending purposes
• • Use Google user data to train, fine-tune, or otherwise develop generalized or non-personalized artificial intelligence or machine learning models, whether our own or those of a third party
• • Allow humans to read Google user data, except with your explicit consent for a specific issue you have raised, where necessary for security purposes or to comply with applicable law, or where the data has been aggregated and de-identified

Revoking access

You can revoke SendFame.com's access to your Google Account at any time from the permissions page of your Google Account at myaccount.google.com/permissions. Revoking access stops future sign-in through Google, but it does not by itself delete your SendFame.com account or the data we already hold. To delete those, use the account deletion process described above or contact us at info@sendfame.com.

Changes to our use of Google user data

If we change the way our app accesses, uses, stores, or shares Google user data, we will update this section and notify affected users by email or by an in-app notice before the change takes effect.

8. Biometric Data, Likeness, and Voice

Photos, videos, and audio you upload to SendFame.com may contain facial geometry, voiceprints, body characteristics, or other biometric identifiers or biometric information of yourself or others. By uploading such content, you provide your express, written, and informed consent to the collection, transmission, storage, processing, and use of any biometric identifiers and biometric information contained in the upload for the purpose of providing the requested service, and you represent that you have obtained the same express, written, and informed consent from every other identifiable person whose face, voice, body, or likeness appears in the upload.

We do not sell, lease, trade, or otherwise profit from biometric identifiers or biometric information. We do not use biometric data to train AI models. Biometric identifiers are not retained separately from the underlying uploaded content beyond what is necessary to deliver the requested generation and are deleted (along with the underlying content, subject to Section 11) within the retention windows described below, in any case not later than three (3) years after your last interaction with the service or when the initial purpose for collection has been satisfied, whichever occurs first.

This Section 8 is intended to satisfy applicable biometric privacy laws including the Illinois Biometric Information Privacy Act (BIPA, 740 ILCS 14/), the Texas Capture or Use of Biometric Identifier Act (CUBI), the Washington Biometric Privacy Act, and the EU General Data Protection Regulation (GDPR).

9. International Data Transfers

SendFame.com is operated from, and your data may be processed in, the United States and any country where our service providers and third-party AI model providers operate. If you access our services from outside the United States, you acknowledge that your information will be transferred to, stored, and processed in jurisdictions that may have different data-protection laws than your own. By using our services, you consent to the transfer, storage, and processing of your data in such jurisdictions. Where required by applicable law (including GDPR), we rely on appropriate safeguards such as Standard Contractual Clauses or equivalent mechanisms for cross-border transfers.

10. Data Security

We have implemented appropriate security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorized way, altered, or disclosed. These include:

• • Encryption of sensitive data
• • Secure storage of AI-generated content
• • Regular security assessments and updates
• • Strict access controls for our staff
• • Data breach response procedures

11. Data Retention

We will only retain your personal data for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. The AI content you generate may be stored as follows:

• • Account data: For the duration of your active account plus additional time as required by law
• • AI-generated content: Stored according to your subscription plan terms
• • Input prompts: May be retained to operate, debug, and improve the quality of our services. We do not train AI models on your inputs, and data received from Google Sign-In is never retained or used for this purpose (see Section 7)
• • Google user data: For as long as your account is active, and deleted within thirty (30) days of account deletion except where longer retention is required by law (see Section 7)

12. Your Rights

Depending on your location, you may have the following data protection rights:

• • Access: Request access to your personal data
• • Correction: Request correction of inaccurate data
• • Deletion: Request erasure of your data under certain conditions
• • Restriction: Request restriction of processing under certain conditions
• • Portability: Request transfer of your data under certain conditions
• • Objection: Object to processing of your data under certain conditions
• • Withdraw consent: Withdraw consent where we rely on consent to process your data

13. Children's Privacy and Age Requirement

SendFame.com is not intended for, and is not made available to, children under the age of 18. Our services require users to be at least 18 years old (or the age of legal majority in their jurisdiction, whichever is greater). We do not knowingly collect personal information from anyone under 18. If you are a parent or guardian and believe we have collected information from a minor, please contact us at info@sendfame.com and we will promptly delete the account and the associated data.

14. California Residents (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act ("CCPA"), as amended by the California Privacy Rights Act ("CPRA"), provides you with the following rights:

• • Right to Know the categories and specific pieces of personal information we collect, use, disclose, and sell or share
• • Right to Delete personal information we have collected from you, subject to certain exceptions
• • Right to Correct inaccurate personal information
• • Right to Opt Out of the sale or sharing of personal information
• • Right to Limit Use and Disclosure of sensitive personal information
• • Right to Non-Discrimination for exercising any of these rights

We do not sell your personal information for money. We may "share" personal information for cross-context behavioral advertising as defined under the CPRA only to the extent we use third-party analytics or advertising cookies; you can opt out at any time by emailing info@sendfame.com with the subject line "Do Not Sell or Share My Personal Information". Data we receive from Google Sign-In is excluded from this: as described in Section 7, we do not use, share, or transfer Google user data for advertising of any kind, including cross-context behavioral advertising.

To exercise any of these rights, contact us at info@sendfame.com. We may verify your request by asking you to confirm information we already hold about you. You may also designate an authorized agent to make a request on your behalf, subject to verification.

15. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to track activity on our website and hold certain information. Cookies are files with a small amount of data that may include an anonymous unique identifier. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent.

16. Changes to This Privacy Policy

We may update our privacy policy from time to time. We will notify you of any changes by posting the new privacy policy on this page and updating the "Last updated" date at the top of this privacy policy. Significant changes may also be communicated via email if you have provided us with your email address.
